Right to Work checks — legally required for every hire

UK employers have a legal duty to verify the right to work of every employee before they start. InfoVetted's digital Right to Work check is Home Office compliant and produces the statutory excuse you need.

What is a Right to Work check?

A Right to Work check confirms that a candidate has the legal right to work in the UK. As an employer, you are required by law to carry out this check before someone starts work — without it, you have no statutory defence against a civil penalty.

Home Office penalties for employing someone without the right to work: Up to £60,000 per illegal worker (civil penalty as of 2024).

All UK employers — no exemptions

  • Permanent and temporary employees
  • Part-time and zero-hours workers
  • Agency workers (duty falls on the agency)

There is no minimum length of employment that removes the obligation.

What InfoVetted verifies

  • British and Irish nationals — passport verification (digital scan); birth certificate + NI number where passport unavailable
  • EEA nationals with UK settled or pre-settled status — digital share code verification via the Home Office online checking service
  • Non-EEA nationals with BRP or BRD — Biometric Residence Permit verification; visa type and expiry confirmed

All results are timestamped, linked to the candidate record, and exportable.

Frequently asked questions

Does a digital Right to Work check satisfy the Home Office requirement?

Yes — digital Right to Work checks have been accepted by the Home Office for most document types since 2022. Certified identity service providers (IDSPs) are used for UK/Irish passport holders. InfoVetted uses a compliant IDSP-backed process.

Do I need to keep a copy of the result?

Yes. The statutory excuse requires you to retain evidence of the check. InfoVetted stores the record and allows you to download or export it at any time.

What if the candidate doesn't have a passport?

Alternative documents (birth certificate + National Insurance, BRP, share code) are accepted depending on the candidate's situation. InfoVetted guides the candidate through the correct document list.
